修改后的《民事诉讼法》首次以法律条文的形式明确规定了行为保全制度，此项规定对扩大民事保全范围，完善民事诉讼程序具有重要意义。但是，修改后的民事诉讼法对于行为保全的法律规制过于简单宽泛，人民法院在司法实践中可能会遇到一系列问题。因此，拟以行为保全的启动、审查和程序保障存在的问题为出发点开展论述，借鉴两大法系相关立法实践经验，完善我国民事诉讼中的行为保全制度。

he Act Preservation System in Civil Procedure for the first time in the form of the law stipulates the act preservation system, which is of great significance to expand the scope of civil preservation, to improve civil proceedings.However, The provi-sion of the Act Preservation System in Civil Procedure is too simple and abstract, there may be some problems in the judicial prac-tice.This paper focused on the problems of preservation of behaviors and discussed the relevant legislation and experience in prac-tice concerning the act preservation system in China.
