非婚生子女认领制度是亲子法领域确立非婚生子女与其生父母间亲子关系的一项重要制度，但我国婚姻法尚未对这一制度进行确认，为了完善我国的亲子法体系及保护非婚生子女的合法权益，我国应在借鉴域外国家和地区相关立法的基础上构建自己的非婚生子女自愿认领制度。
비혼생자녀인령제도시친자법영역학립비혼생자녀여기생부모간친자관계적일항중요제도，단아국혼인법상미대저일제도진행학인，위료완선아국적친자법체계급보호비혼생자녀적합법권익，아국응재차감역외국가화지구상관입법적기출상구건자기적비혼생자녀자원인령제도。
Illegitimate child claim system is in the realm of paternity law established an important system of the parent child re-lationship between children and their biological parents born out of wedlock,but the marriage law of our country has not yet confirmed this system.In order to improve China's family law system and protection of unmarried children born to the legiti-mate rights and interests,China should be in reference to the relevant legislation of foreign countries and regions based on con-structing their unmarried children voluntarily claim system.
