《侵权责任法》第49条关于责任主体的规定并未采纳“运行支配和运行利益”这一界定标准。机动车使用人承担责任的法律基础是《道路交通安全法》第76条，该条并未规定单一的危险责任原则。因此，风险开启、危险控制、运行利益等均不构成使用人承担责任的理由。机动车所有人将具有安全技术缺陷的机动车租借给他人或者将机动车租借给醉酒、无驾照之人，其行为的危险程度并不亚于拼装车、报废车所有人的转让行为。举轻以明重，立法者应当重新评估租借缺陷机动车或者向无驾照、醉酒之人租借机动车的危险性，统合《侵权责任法》第49条与第51条，规定所有人与使用人对受害人承担连带赔偿责任。

Article 49 of Tort Liability Law does not adopt the standard of actual control and operational interest to define the subject of motor vehicle accident liability .The user of the motor vehicle assumes for damages according to article 76 of Road Traffic Safety Law , which doesn ’ t provide single responsibility principle .Accordingly , the risk opening , risk control and operating profit cannot constitute the reason for the users to take the liability .If the motor vehicle owners lend or lease the motor vehicle with safe or technical defects to others , or to the drunk drivers , or drivers without driving license , the risk of their be-havior is not less than the behavior of selling scrap cars to others .Accordingly , legislators should re-e-valuate the risk of such behavior of leasing .According to the integration of article 49 and article 51 in Tort Liability Law, if the owner of the motor vehicle is at fault for the damage , he or she shall bear the corresponding compensation liability .
