除俄罗斯法外，比较法上侵权补充责任并未获得独立地位。只有在体系化中侵权补充责任才能获得独立地位，而其关键是：在理清与连带责任、不真正连带责任关系的基础上形成完整的多数人侵权责任体系。在参照一般补充责任设立法律效力的前提下，形成民法上完备的补充责任体系。侵权补充责任具备拾遗补漏的赔偿功能，其规范兼容应然与实然，具有严格法属性。未来立法应当承认补充责任人之先诉抗辩权和追偿权，并限缩其责任范围。

Except in Russia , complementary liability in tort law is not deemed to be independent in com-parative laws .Only systematization can foster the independence of complementary liability in tort law , and the key to this is to form a complete tort law liability system after clarifying its relationship with joint&several liability , and unreal joint &several liability .Under the premise of referring to the legal effect of ordinary complementary liability , the complementary liability system in Civil Law shall come into be-ing.The complementary liability in tort law shall possess the function of compensating the omitting part , whose specifications shall balance between what ought to be and what is , possessing the quality of ius strictum .The future legislation shall have to admit that the party bearing the complementary liability shall enjoy the benefit of discussion and the right of recourse within a limited scope .
