“蒙汉双语司法”制度是在“民族语言文字诉讼”制度的基础上延伸出来的新型制度。影响蒙汉双语司法人员结构的因素是多方面的，蒙汉双语司法人员短缺，严重影响蒙汉双语司法工作的顺利开展。现有蒙汉双语司法人员中多数不能用蒙古文字制作法律文书，导致“蒙汉双语司法”制度由“民族语言文字诉讼权利”的保障职能，向“民族语言诉讼权利”的保障职能的转变。改善蒙汉双语司法人员短缺问题，改变司法机关招录蒙汉双语司法人员办法，将蒙汉双语司法人员纳入特殊人才、特殊岗位的行列；使用特殊公务员招录办法，合理配置司法人员结构中蒙汉双语人才的比例；改革高校法学专业培养方案和课程设置，为司法机关输送合格的蒙汉双语司法人才。

The new system"Mongolian and Chinese justice"is an extension on the basis of"national language litigation"system. Factors affect the structure of Mongolian and Chinese judicial officers are multifaceted. Shortage of Mongolian and Chinese judicial officers is seriously affecting judicial work smoothly of Mongolian and Chinese. Most of Mongolian and Chinese judicial officers can’t make legal instrument in Mongolian words. Lead to the"Mongolian and Chinese justice" system from the support functions of the "National Language litigation rights" transfer to the"national language rights litigation". We should improving the system to employing judicial officers, bring the Mongo-lian and Chinese judicial officers in the special rank of judicial person, Apply special way to employing civil servants, allocate the proportion rational of the judicial officers’structure of Mongolian and Chinese person. Reform the train-ing programs and curriculum of university in law major, then provide qualified judicial talented person for judiciary of Mongolian and Chinese.
