从语义上看，“不符合食品安全标准”的辨识较为简单。但食品安全标准本身就属于一种开放性的技术标准或规范。故司法机关必须对其将欲援引的事项进行独立判断，突破“标准”的形式束缚，彰显“安全”的核心价值。一方面，即使某标准条款在名义上确实属于“食品安全标准”，也应当进行独立评价，而不能简单地直接援引；另一方面，尽管某一具体规则没有在形式上被纳入“XX 标准”，但只要直接关乎“食品安全”，可能损及“公众健康”，也依然存在适用的余地。
