非法证据排除规则作为诉讼中的一项不可替代的程序规则，反映了一个国家司法的民主化、科学化的发展程度。适用非法证据排除规则不仅是司法公正中程序正义的集中体现，也是人权保障的基本要求。检察环节适用非法证据排除规则的优势来源于它对诉讼的全程参与性、职能前置性以及排除非法证据的机动灵活性，这些优势决定了检察机关对于非法证据排除居于最为重要的位置。检察环节下非法证据排除机制的构建和完善，笔者认为应当从非法证据的发现机制、调查机制、认定机制、处理机制、救济机制以及相关配套机制等方面对其进行重构与强化。

The illegal evidence exclusion rule,as a non replaceable procedure rule,reflects the development of democracy and science in a country.The application of the rule of illegal evidence exclusion is not only the concentrated expression of proce-dural justice in judicial justice,but also the basic requirement of human rights protection.The part of the prosecution for illegal evidence exclusion rules advantage comes to its full of litigation in,prepositional functions and the exclusion of illegal evidence of flexibility.These advantages determines the procuratorial organs for the illegal evidence excluded living in the most important position.Part of the prosecution of illegal evidence exclusion mechanism to construct and perfect,the author thinks that should from the illegal evidence discovery mechanism,investigation of the mechanisms,cognizance,processing mechanism,relief mechanism and related mechanism of reconstruction and strengthening.
