我国历史上有着优秀的法治思想传统，但法治实践不足，缺少执法和守法的传统，法治文化欠缺，就使得新中国建立以来在很长一段时期对法治建设的重要意义认识不够，强调不够。面对为实现中华民族伟大复兴中国梦奋斗目标的新形势新任务，党的十八大提出了“全面依法治国”，但是如何走上社会主义法治国家，拙文认为要努力培育和践行法治文化，一是设立宪法节，树立法治信仰；二是把法治教育纳入国民教育序列，提高法治文化培育的有效性；三是根植中华文化沃土，隆德重法两手抓；四是打造法治人才队伍，建设法治文化研究相关基地。

In history,China has the excellent tradition of rule by law.However,its practice is not adequate.Further-more,we lack the tradition of law enforcement and abiding.The lack of culture of rule by law has led to the inadequate under-standing of and emphasis on significance of legal construction for a long time sine the founding of new China.In the new period when we face the new task of bringing Chinese dream of national rejuvenation into reality,the 18 th CPC National Congress put forward that we comprehensively rule our country by law.But how to become a rule-by-law country? This paper believes that, in order to form and practice legal culture,we have to do four things.First,we should have a Constitutional Day in order to confirm people’s legal belief.Second,we can bring legal education into the content of national education to increase the effec-tiveness of legal culture’s cultivation.Third,we should root ourselves in Chinese culture and stress both moral and law.Last, we should train a talent team of rule by law and build bases for the study of legal culture.
