肉刑作为野蛮刑罚方式，产生于原始社会，是古代中国刑罚体系的重要成分之一，虽在震慑暴力犯罪、降低犯罪频率上产生过一定的正向作用，却对受刑者的身心造成巨大摧残。不仅如此，过度依赖肉刑行使国家刑罚权力易于激化阶级矛盾，影响社会稳定。自汉代刑制改革之后，肉刑作为“旧五刑”的主体逐渐被封建“新五刑”所取代，这是我国法制史上的一个关键转折点，它有力地推动了刑罚执行文明化的历史进程。但在封建社会发展后期，肉刑又出现在国家刑罚体系中，并在某些层面被进一步强化，这是古代中国社会特殊的肉刑复活现象。其中，宋代刺配刑罚被运用于司法实践，是该司法现象的典型例证。刺配制度是理解肉刑复活问题的合理切入点，也是透过肉刑复活现象分析其本质与历史意义的重要客观材料。

Corporal punishment as a barbaric punishment,resulting in the primitive society,is one of an important component of penalty system in ancient China,although in deter violent crime,reducing the crime has had a certain positive role,but the victim’s body and mind was suffered great destruction;not only that,excessive dependence on corporal punishment exercise state power of punishment as well as easy to intensification of class contradictions and affect social stability.Since the reform of penal system in Han Dynasty,corporal punishment as the main body of the old five penalties is gradually replaced by the feudal new five penalties,which is a key turning point in the history of legal system in our country,it effectively promote the penalty in the history of civilization.But in the late feudal society,corporal punishment e-merged again in countries’penalty system,and on some level has been further strengthened.This is the phenomenon of corporal resurrection in ancient China’s society.Among Cipei punishment of Song Dynasty is a typical example of the judicial phenomenon and used in the judicial practice.Therefore,Cipei punish-ment is a reasonable starting point for understanding corporal resurrection,through the nature of corporal resurrection is also an important objective material to analyze essence and historical significance.
