不动产登记公信力制度和善意取得制度是保护第三人信赖利益、维护交易安全的两种不同制度设计。我国《物权法》第106条并没有承认不动产登记的公信力,而是将不动产纳入了善意取得制度中。这一保护模式不仅与善意取得制度的逻辑体系相矛盾,而且其规定本身模糊不清。因此,应当以不动产登记公信力取代不动产善意取得制度。但在《物权法》和《婚姻法》的衔接问题上,考虑到夫妻关系的伦理性、夫妻共有财产登记的特殊性以及隐名权利人的利益保护需要,应当对不动产登记公信力予以修正,在一定范围之内可以适用善意取得制度。

Real estate registration credibility system and bona fide acquisition system are two di fferent mechanisms to protect the reasonable reliance interest of the third party as well as maintain t he transaction security. The Provision 106 of Property Law clearly defines the system of bona fide acquisition of real estate. This kind of protection mode not only contradicts logical system of bona f ide acquisition, but also equivocal the provision itself. Therefore, bona fide acquisition of real estate should be replaced by real estate registration credibility system. However, real estate registration cre dibility system can’t be applied when involving community property. Considering the ethical relations hip of married couple, the particularity of community property register and the benefit of silent hold er into consideration, real estate registration credibility system should be revised, and bona fide acqu isition can be put into practice within certain limits.
