由于空间权理论在我国立法上的长期缺位,审判实践中莫衷一是的裁判观点,地下空间权属登记的措施留白,造成地下车位权属交易纠纷不断涌现,鉴于地下车位作为地下空间利用权的研究对象颇具典型性和代表性,其不仅具有法理上的适格性,还兼具回应社会关切的重要性,对同属地下空间利用权范畴内的其他地下空间利用权属纠纷之解决更具借鉴性和适用性。故此,需对以地下车位为代表的我国地下空间利用权理论做更进一步的讨究和思考,与此相应,通过构建完善的地下空间利用权利制度体系,既可将对规范地下车位权属交易提供法律制度规范依托,又可供实现拓展适用至规范其他地下空间利用行为之目的。

Due to the lack of the theory of space right in China’s legislation, the often controversial referee reviews in trial practices and the measures that underground space is registered by tentatively are still a blank, which brings about the underground parking space ownership being sprung up unceasingly by the business disputes temporarily. In view of its being typical and representative, underground parking space is chosen as the object of study in underground space right. On the legal nature of the law and the importance of responding to the social concerns, it has reference and applicability to the solution of the other underground space ownership disputes. Therefore, further discussion and consideration should practice to China’s underground space right taking underground parking space as a representative. Relevant departments are expected to respond by structuring thorough underground space right system so that to provide standard backing of legal system on underground parking space ownership business and to achieve the aim of applying to standardize other underground space behavior.
