修改后的《刑事诉讼法》第37条赋予辩护律师自审查起诉之日起会见在押的犯罪嫌疑人、被告人时，有“核实有关证据”的权利，其是否允许向被告人出示同案犯供述、证言等，成为正在制定的关于律师刑事辩护若干问题的规定中的主要争议点。从我国立法意图、独立辩护理论、保障查明事实真相的角度，对辩护律师核实证据的权利进行限制很有必要。然而，对辩护律师行使核实证据的权利，不应采取证据类别的限制方式，应要求辩护律师遵守“存疑核实”的原则，将涉密信息排除在核实之外，且以口头交流的核实方式为主。

Subject to Revised Criminal Procedure Law Section 37, the defense lawyers are entitled to the right to verify the relevant evidence, during the time when they are authorized, after the review of the indictment is enacted, to meet with the criminal suspect or the defendant in custody. The issues that whether the lawyers are allowed to introduce to the suspect or the defendant an accomplice confession or an accomplice’s testimony becomes the main controversial problem in the ongoing regulation making process on Provisions on Several Issues Concerning Lawyers Providing The Criminal Defense. Taking into account of the lawmaker’s intent, the theory of independent defense, and the value of ifnding the truth, it is necessary to limit the defense lawyers’ right to verify the evidence. However, the limit should not be based on the categories of evidence. It is appropriate to propose that the defense lawyers observe the principle of"questionable veriifcation”, defense lawyers are not allowed to verify classiifed information, and the veriifcation should be conducted in the form of oral communication.
