从法律解释遭遇的困境与期望效用最大化角度考虑,结果导向的司法裁决采取先对后果进行预测再评价的"逆推"模式,更有利于疑难案件的解决. 结果导向思维的案件处理与司法权社会治理的功能目标是一致的. 结果导向思维主要服务于疑难案件的解决,若不能很好地把握案件类型与裁决思维的平衡点,不仅无益于消解法安定性与个案正义间的冲突,而且法治也可能面临被社会效果论异化的恣意造法之危险. 以理性商谈沟通的视角审视法教义学与社科法学之争,发现当今法教义学可向经验实证的社会科学开放. 而面向社会科学与本土实践的法教义学,一个显著特点就在于接受结果导向的裁决思维,即能够尝试运用社会科学的理论方法来预测、评估裁判的社会效果.

When the legal interpretation dilemma and the expected utility maximization are taken into consideration, result-oriented judicial decision, taking a"backward induction" model, is more advantageous to the solution of the hard cases .Case processing guided by the result -oriented judicial thought is in consis-tency with the functional goal of the jurisdiction of social governance .Result-oriented judicial thought aims at solving hard cases , and failure in striking a balance between case types and adjudication thought will not only be of no benefit for solving the conflict between legal stability and case justice , but will also bring rule of law into such a dangerous situation as to be aliened by social consequences and willful law -making .This paper proposes that if the argument between legal dogmatics and social science jurisprudence viewed from the per -spective of rational discussion and communication , legal dogmatics nowadays may open to the empirical social science that stresses experience .And one remarkable feature of legal dogmatics open to social science and lo-cal legal practice is to accept result -oriented judicial thought and to predict and evaluate the social conse-quence of judicial decision by applying the theories and methods of social sciences .
