新《旅游法》的颁布与实施，意味着在法律层面上遏制了危害中国旅游业秩序的最大因素--“零负团费”。但是作者对此持有不同看法，认为“零负团费”现象在一定程度上促进了旅游业的发展。本文首先对以前学者关于“零负团费”现象成因的分析进行归纳和总结，并提出了自己不同的见解；然后试探性的分析了“零负团费”现象的本质；最后就《旅游法》取缔“零负团费”现象的影响做了探讨。

The promulgation and implementation of new"tourism law", means that The biggest factor--"zero negative tour fee“of hazarding China tourism order has been curbed. But the author holds a dif erent opinion, thinking that the phenomenon of"zero negative tour fee"has promoted the development of tourism in a certain extent. Firstly this paper summarizes the contemporary progress of the study of “Zero or negative tour fee” and points out dif erent opinions about it; Then tentatively analyses the most essential reason of the phenomenon of“Zero or negative tour fee”;Lastly this paper discusses the impact of“Tourism law”banning“zero or negative tour fee”.
